Who provides the services
These terms cover the use of this website and the general framework of our engagements. Services are provided by DIGITALTUGA — [COMPANY LEGAL NAME], tax number [COMPANY TAX ID], registered at [COMPANY ADDRESS], Portugal. Official contact: geraldigitaltuga@gmail.com — we never invoice or request payment from any other email address.
Using this website
This website presents DIGITALTUGA's services. You are welcome to browse it and share it. Please do not copy its design or content to represent another business, and do not attempt to disrupt its operation.
Scope of services
- Design and development of websites, online stores and landing pages.
- Backends, APIs and custom software.
- Maintenance and support plans for what we build.
- Sales and growth systems for our clients.
Our services are aimed at businesses and professionals (B2B). Exactly what is included in a given project is defined in its written proposal.
Quotes, proposals and prices
- Nothing on this site is a binding offer. Prices and timelines become fixed only when a written proposal is accepted by both sides.
- Custom software is priced only after consultation — its scope varies too much for a standard price list.
- Each project is governed by its own proposal or contract, which prevails over these general terms.
- Proposals are valid for 30 days unless stated otherwise.
- Timelines assume the agreed feedback and materials arrive when scheduled; if they do not, delivery dates move accordingly.
Payment
- Unless a proposal says otherwise, work is invoiced in instalments tied to agreed milestones — typically part on start and the remainder on delivery — payable within 15 days.
- Payments are made through secure payment links we send from our official email. We never ask for card details by phone or email.
- Work on a milestone may be suspended while a due instalment remains unpaid; deadlines extend accordingly.
- Ownership of deliverables transfers on final payment (see below).
Mockups and previews
Before a contract, we may show you mockups or design previews of what your project could look like. These remain DIGITALTUGA's property, are shared under confidentiality (NDA), and may not be used, reproduced or handed to third parties to build the design elsewhere unless the project is contracted or we agree otherwise in writing.
Intellectual property
- The DIGITALTUGA name, logo and the contents of this site belong to us.
- Until full payment, all designs, code and other deliverables remain DIGITALTUGA's property.
- On completion and full payment, the deliverables and their source code become the client's property, as detailed in each contract. This is our zero lock-in policy.
- Third-party components keep their own licences, which we identify in the hand-over documentation.
- We may reference delivered, publicly visible work in our portfolio unless the contract says otherwise.
Warranty and maintenance
- We correct, free of charge, defects in the delivered work reported within 30 days of delivery, unless the proposal defines a different period.
- Ongoing updates, content changes, hosting management and evolutions are covered by an optional maintenance plan, quoted separately.
- The warranty does not cover changes made by third parties, misuse, or failures of external services (hosting, domain registrars, third-party APIs) outside our control.
Client responsibilities
The client guarantees that content and materials supplied to us (text, images, brands, data) are theirs to use, and remains responsible for the legal compliance of their own business activity conducted through the deliverables.
Confidentiality
Anything you share with us in the course of an enquiry or a project is treated as confidential and is not disclosed to third parties without your agreement. Where an NDA is signed, its terms prevail.
Liability
This website is provided "as is". We work to keep its information accurate but do not guarantee it is free of error. To the extent permitted by law we are not liable for indirect damages arising from its use. Within projects, our total liability is capped at the amount paid for the project in question, except where the law does not allow such a limit; details are defined in each project's contract.
Personal data
How we handle personal data — including how our outreach works and how to opt out — is described in the privacy policy and on Why we contacted you.
Governing law and jurisdiction
These terms are governed by Portuguese law. Disputes are submitted to the competent Portuguese courts, without prejudice to any mandatory rules in the client's country.
